At Trueform Concrete, LLC (“Trueform”), providing high-quality craftsmanship and excellent customer service are our top priorities. We are pleased that you (“Customer”) have chosen to purchase one or more of our items (“Products”), and we want you to be fully satisfied with your purchase and experience with our company. Please take a moment to carefully review all of our Terms and Conditions before placing your order. These Terms and Conditions govern the purchase of all Standard and Custom products from Trueform Concrete, whether ordered through our website or directly via our sales team. By placing an order, the Customer agrees to these Terms and Conditions, which outline the rights, responsibilities, and obligations of both Trueform Concrete and the Customer. Conditions of Use

By using this website and purchasing products from Trueform, you agree to all the terms and conditions outlined below.

1. Payment Terms & Terms of Sale

1.1 All orders are subject to Trueform’s express, written approval.
1.2 Standard products require full payment at purchase. Custom products require a 50% deposit, with the balance due at shipping.
1.3 Trueform accepts Visa, MasterCard, Discover, American Express, checks, and wire transfers. Orders paid by check or wire transfer will only be processed after funds have cleared.
1.4 Trueform retains ownership of all products until full payment is received.
1.5 Prices listed on the website are subject to change without notice.
1.6 Payments for orders received on weekends or holidays will be processed on the next business day

2. Customer Responsibilities

2.1 Customers must:
- Respond promptly to Trueform’s requests for instructions, approvals, or information needed for production.
- Cooperate with Trueform during manufacturing and delivery, including providing necessary access to premises, employees, or equipment.
- Obtain any required licenses, approvals, or permits to prevent delays.
- Secure advance approvals from building management for deliveries, if applicable.
2.2 Customers are responsible for protecting the product after delivery, as Trueform products are delivered with minimal packaging.

3. Order Modifications and Cancellations

3.1 Custom products cannot be canceled, returned, or exchanged.
3.2 Standard products may be canceled within 30 days, subject to a 25% restocking fee. Customers are responsible for return shipping costs.
3.3 Changes to orders after production has begun are subject to additional charges and Trueform’s approval.

4. Drawings and Templates

4.1 If drawings are required for production:
- Customers must review and approve them before fabrication begins.
- Trueform is not liable for inaccuracies not reported before manufacturing.
4.2 If a template is required:
- The project site must be ready before Trueform’s arrival (e.g., cabinets and sinks installed, countertops removed).
- Customers or authorized representatives must be present during template creation to ensure accuracy.

5. Shipping and Delivery

5.1 Ground Service and Freight Carrier Deliveries:
- Freight deliveries may require appointments. Customers must provide accurate contact information for scheduling.
- Failed delivery attempts will result in additional charges.

5.2 Inside Delivery:
- Customers must be present at the scheduled time to receive and inspect the shipment.- Customers must ensure sufficient access for delivery (e.g., freight elevators, loading docks).
- If access is inadequate, customers are responsible for arranging an alternative delivery location.
- Additional fees will apply for missed delivery appointments or redelivery services.

5.3 Installation Services:
- Trueform does not provide plumbing, electrical, or cabinetry modifications.
- Customers must comply with all laws, codes, and permits related to installation.
- No one except Trueform personnel may handle products during installation.

5.4 Customer Responsibilities upon Delivery:
- Inspect all packages immediately upon receipt.
- Report damages or shortages within 48 hours of delivery.
- Failure to report issues within this time frame may result in denial of claims.
- Trueform is not liable for damages reported after this period.

6. Fees and Additional Charges

6.1 Storage Fees: A $10/day storage fee will apply if a product is not picked up or delivered within 10 days of the scheduled date.

6.2 Overtime and Additional Labor Charges: Customers requesting work outside regular hours will be charged 1.5 times the regular rate per hour.

6.3. Late Payment Charges: Late payments are subject to a 2% monthly interest charge.

7. Sales Tax Policy

Trueform is required to collect applicable sales tax for orders shipped within most U.S. states unless the Customer provides a valid resale certificate at the time of purchase. Failure to provide this documentation will result in the inclusion of sales tax on the invoice.

8. Errors & Omissions

Trueform strives to provide accurate information across all print and electronic media. However, typographical errors, inaccuracies, or omissions may occur. Trueform reserves the right to correct these errors and not fulfill orders based on incorrect pricing or misleading information.

9. Warranty

9.1 Trueform warrants for one (1) year that products are free from defects in materials and workmanship under normal use.
9.2 Exclusions:
- Hairline cracks, chips, scratches, or staining due to misuse or neglect.
- Variations in texture, color, or appearance inherent to concrete products.

10. Intellectual Property

10.1 Trueform retains ownership of all molds, drawings, and intellectual property created during the project.
10.2 Customers may not modify, reproduce, or distribute drawings without Trueform’s written consent.
10.3 Trueform may use project photographs for promotional purposes.

11. Confidentiality

Both parties agree to protect any non-public, proprietary information shared during the project.

12. Limitation of Liability

12.1 Trueform is not liable for:
- Indirect, special, or consequential damages.
- Misuse, neglect, or accidents involving the product after delivery.
12.2 Trueform’s liability is limited to the repair or replacement of defective products reported within seven (7) days of delivery.

13. Force Majeure

Trueform may terminate the agreement due to uncontrollable events such as natural disasters, strikes, or public health emergencies.

14. Governing Law and Jurisdiction

14.1 This agreement is governed by the laws of New Jersey.
14.2 Any disputes must be resolved exclusively in the state or federal courts located in Morris County, New Jersey.

15. Disclaimer

By purchasing and installing Trueform products, you agree that Trueform, its employees, and affiliates, cannot be held responsible for accidents, liabilities, or damages caused by misuse or improper handling of its products.
